STANDARD COMPETITION TERMS & CONDITIONS

1. These are the standard terms and conditions for competitions conducted or promoted by or in association with Jockey South Africa.

2. Your entry into the competition and/or your acceptance of a prize constitutes your binding acceptance of the terms and conditions on behalf of yourself and any person with whom you may share a prize.

3.  Competition Period

   These terms and conditions are for our promotional competitions. 

   The Competition will run from 7th August 2023 until 30th September 2023. The draw for the main prize will take place on the 6th October 2023.

   The successful entrants will be contacted within 10 working days of the entries closing.

   The duration of the competition may be shortened or extended at the discretion of the Organiser.

   It is the responsibility of participants to ensure that your entry is received by us prior to the closure of the competition. Any entries which are not received by us prior to the closure of the competition will not be eligible to participate, regardless of the reason for the late entry.

   Without limitation, we and our affiliates are not responsible for any problems or technical malfunction of any telephone network or lines, online applications, computer on-line systems, servers, or providers, computer hardware or software failure or malfunction, traffic congestion (whether physical, or on the Internet, telephone lines or at any service provider, web site or other device or medium), or any combination thereof, or any other technical or other problems

4. Eligibility

   To be eligible to participate in this competition, the participant must:

   Be a natural person and not a juristic entity, which juristic entity includes but is not limited to a Business to Business (B2B) partner of the organisers, cross border partner or retail partner of the organiser. 

   The entry must be completed in the participant’s name.

   The participant will be required to provide all the correct information. 

   The organiser will not be held responsible for incorrect information supplied, as a result the contestant may not being contacted due to this.In the event that an uploaded purchase receipt does not conform to the organiser’s requirements, the participants entry will be considered unsuccessful.

   Prizes of this competition are not eligible to employees and family members of the employees of Jockey or any participating retail store involved in the competition. 

   Entrants under the age of 18 must obtain permission from their parents or guardians before entering.

   The competition is not open to:

   Directors, members, partners, agents, employees, or consultants of the JOCKEY SOUTH AFRICA Group of companies / brands or any supplier of goods or services in connection with a competition; and the spouse, life partner, business partner or associate, or the natural or adopted parent, child, or sibling, of any of the persons specified in above.

   We and our affiliates are not responsible for any injury or damage to you or any other person’s computer, mobile telephone or other device used by you to enter or obtain any materials related to the competition.

   Any costs or expenses which you may incur other than in respect of those items specifically included in a prize are for your own account. JOCKEY South Africa will not be responsible for any costs or expenses which you, or your partner (if applicable), incur during and for purposes of your entry into the competition and your acceptance and/or use of a prize.

   We do not make any representations or give any warranties, whether expressly or implicitly, as to a prize, and in particular, but without limitation, make no representations and give no warranty that your entry or participation in the competition will necessarily result in you winning a prize; or any aspect thereof, will meet your, or, if applicable, your partner’s, requirements, preferences, standards or expectations; or any aspect thereof, will be satisfactory, punctual, free from defects, safe or reliable.

5. Competition Entry and Mechanics: 

   To enter the Screening Experience competition, participants must purchase a Jockey garment either online, in-store, or participating retailer during the Competition Period and follow the entry mechanics as described below.

   Entries may be submitted online only via the competition entry landing page in one of two ways:

   • At any participating store: Upon purchase of a Jockey garment, the entrant may scan the QR code on the garment purchased, and enter the competition through the landing page directed to upon scanning the QR code on the garment. The entrant must agree to the terms and conditions on the landing page, and provide contact information, including name, surname, email address, telephone number, and province. The entrant will need to upload their receipt on the landing page as proof of purchase. Original proof of purchase (receipt) is required should the entrant be chosen as a winner. Should the entrant not have original proof of purchase in form of the original receipt, Jockey reserves the right to do a redraw for the competition and offer the prize to an entrant who is able to show original proof of purchase.
   • Online purchase on the Jockey website: Upon any online purchase on the Jockey website, the entrant will be given the option to enter the Jockey World Cup Competition. The entrant must agree to the terms and conditions and provide contact information, including name, surname, email address, telephone number, and province. Proof of purchase will be logged automatically via the Jockey online store, which qualifies the entrant for entry into the competition.
   • Entrants to the competition can only enter the competition once. Duplicate/multiple entries to the competition will not be counted in the competition as qualifying entries. The entrant may not use multiple accounts, and anyone found to use multiple accounts to enter will be disqualified.

   To enter the Subscriber Competition to win a Jockey hamper valued at R5000, participants must subscribe to the Jockey database in the months of August or September, via our Facebook lead generation campaign running 7th August to 30th September.

   To enter the engagement photo competition to win a Jockey voucher to the value of R1000, entrants must submit a selfie/group photo of themselves and their friends enjoying a sports game during August and September, and tagging Jockey South Africa on Facebook and Instagram.

6.  Prize Details

   Main Competition: The winner of the Competition will stand a chance to win a festive world cup screening experience for them and 20 of their friends, valued at R50,000. This prize is redeemable and valid for the date of the 28th October 2023 only to avail of the festive screening experience. Should the winner not be able to make the set date for the screening experience, Jockey reserves the right to redraw for a new winner.

   The main prize includes, a home theatre set up at your home for you and 20 friends, together with food and beverage catering, a Jockey hamper, and a photobooth experience. The home theater system is for event use only and will be removed after the screen is concluded. 

   Subscriber Competition: The winner will receive a Jockey Hamper to the value of R5,000. On receipt of the winners delivery details - delivery can be expected within the following 10 working days thereafter.

   Engagement Competition: The winner will receive a R1000 Jockey voucher to spend online on the Jockey website (www.jockey.co.za). This voucher will be valid for 6 months from the date of issue.

   The prizes are not transferable, and no cash alternatives or other retailer vouchers will be offered.

   Prizes must be redeemed / experienced within the borders of South Africa.

7. Winner Selection and Reward:

   Prizes are not transferable and may not be deferred, changed, or exchanged for cash or any other item or size.

   You must possess whatever personal documents and permissions that may be required in order to accept and use a prize, and which documents and permissions must remain valid in such minimum form and for such minimum period after the prize date as may be required by the relevant authorities.

   The winners will be notified by means of the contact details provided to us. If we are, or a third-party supplier is, unable to contact a winner within 3 working days from the draw date, or if the winner is unable to collect the prize within 10 working days, the winner will forfeit the prize and JOCKEY South Africa reserves the right to redraw a new winner under the same conditions.

   The winner will be expected to participate when the prize winners are determined or announced, to participate in any of our marketing activities, to appear in person in the electronic media and/or the print media, and/or to endorse, promote or advertise any of our goods or services, for which no fee, royalty or other compensation will be payable. We may publish names of the participants and winners on any of our communication platforms.

   We may require you to provide us with such additional information and personal documentation which will include receipt of purchase and original identification, as we may reasonably require processing, confirming, and facilitating your acceptance and/or use of a prize. If you refuse to provide us with the requested information or documentation, you will forfeit the prize.

   All correspondence regarding the three prizes must be directed to Jockey South Africa. 

   JOCKEY South Africa will not be responsible for any further correspondence, harm, damage, loss, or claim relating to the provision of any element of the prize.

   We and our third party suppliers reserve the right to vary, postpone, suspend, or cancel the competition and any prizes, or any aspect thereof, without notice at any time, for any reason which we deem necessary. In the event of such variation, postponement, suspension or cancellation, you agree to waive any rights, interests, and expectations that you may have in terms of this competition and acknowledge that you will have no recourse against us, our affiliates and third-party suppliers.

   By participating in the competition and accepting and/or using a prize or any aspect thereof, you acknowledge that it is done entirely at your own risk. We and our affiliates will not assume any responsibility and deny all liability for any loss, liability, injury, expense, or damage (whether direct, indirect, incidental, punitive, or consequential) of any nature, regardless of whether it arises from negligence or any other cause. Such losses or damages may be incurred during your participation in the competition or the acceptance and/or use of a prize by you or others receiving the prize, or by any action taken by us or any of our affiliates in accordance with the terms and conditions.

   In the event of your death, your family, dependents, heirs, assignees or any other beneficiaries of your estate, indemnify and hold us and our affiliates harmless against any claim by you, or your partner (if applicable), (whether direct, indirect, incidental, punitive or consequential) of any nature, we may not be obligated to fulfill any of the prizes.

8.  General Competition Terms: 

   For purposes hereof, "affiliate" means our partners, co-promoters and sponsors of this competition, our subsidiaries, fellow subsidiaries and respective holding companies, and our and their directors, officers, employees, agents, and representatives.

   These terms and conditions will be construed, interpreted, and enforced in accordance with the laws of contract and dispute resolution in the Republic of South Africa.

   In accordance with POPIA, JOCKEY and the competition sponsor(s) will be regarded as joint responsible parties. Your data subject rights, as detailed in our Privacy Notice on our website, will be fully respected and honored.

   Regarding the retention of information, we will adhere strictly to the guidelines outlined in the Privacy Notice for Jockey South Africa. 

   If you use a mobile phone or any other personal device for entry into the competition, the data you use will be charged at the prevailing rates, which may vary from time to time. 

9.  Limitation of Liability:

   To the extent permitted by Consumer Protection Act and any other applicable law:

   The Participant and/or winner(s) hereby indemnifies the Organiser against any direct, indirect, special, incidental, consequential, or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the Participants entrance into the Competition.

   You acknowledge that the acceptance and use of a prize is subject to the provision that –

   All of the terms and conditions will apply to you.

   Any minor will be accompanied by a parent or legal guardian.

   If you fail to comply with any of the terms and conditions, then without prejudice to any other remedy which we may have, –

   You will be automatically disqualified, and you will forfeit the prize/s.

   You will pay us for any loss or damage incurred by us directly or indirectly as a result of your  non-compliance, including all of our legal costs which we may incur in taking any steps pursuant to your non-compliance
